Cancellation Conditions:
• The information provided by you during the application and booking process is proven to be false; and/or
• You do not meet the student status requirements; and/or
• You fail to sign the "Residential Lease Agreement"/"Occupancy Permit" as requested; and/or
• You fail to pay the initial deposit/booking fee; and/or
• You fail to pay the security deposit by the specified due date.
Please note that after payment of the initial deposit, you will be required to sign the "Lease Agreement"/"Occupancy Permit"/"User Agreement" and submit the security deposit within one week. If you fail to comply with this requirement, Y Suites reserves the right to cancel your booking and forfeit your deposit.
Cancellation before the start of the lease:
No Visa No Pay
If you fail to obtain a visa for studying in Australia successfully before the lease start date, you need to send a written email requesting cancellation.
A written email requesting cancellation must be submitted to the hotel where you booked within 24 hours of receiving notification from the Department of Home Affairs and the email informing you of the refusal to study in Australia. You will then be formally notified that your lease agreement or occupancy permit will be canceled without penalty.
Notice within 14 days prior to the commencement date: Partial refund may be granted, subject to loss.
Selected room type not available
If we cancel the reservation due to the selected room type being unavailable, Y Suites may also offer flexibility in refunding the deposit.
Cancellation for all other reasons
• The prepaid deposit, including the $55.00 AUD fee for shower curtains and mattress protectors, will be retained as it is non-refundable.
Cancellation after the commencement of the lease:
You will be required to sign the "Residential Lease Agreement", "Rental Housing Agreement", and "Occupancy Permit" upon arrival. Once the "Residential Lease Agreement", "Rental Housing Agreement", or "Occupancy Permit" is signed, the terms and conditions of the "Lease Agreement" and "Rental Housing Contract" or "Occupancy Permit" will apply and supersede any other cancellation policy conditions.
The "Residential Lease Agreement", "Rental Housing Agreement", or "Occupancy Permit" is a legally binding document, and violation of this agreement will result in penalties. If residents believe they are unable to occupy the room or continue to pay rent/accommodation fees, they must notify the Y Suites management in writing and complete the lease interruption form as soon as possible.
When considering early termination of your "Residential Lease Agreement" or "Rental Housing Agreement", you are responsible for the following:
• Continuing to pay the remaining rent of the agreement or until the apartment is re-rented, plus a portion of the rental and advertising fees (if you have designated Y Suites to advertise on your behalf, calculations will be based on the Residential Tenancies Act formula).
• You can assist in finding another suitable person who needs to apply to Y Suites and have their application accepted by management to take over your apartment.
• A departure cleaning fee may be charged if the apartment is not returned in the same or better condition to the owner.
When considering early termination of your occupancy permit, you are responsible for the following:
• If you terminate the occupancy permit within the first 48 weeks after the occupancy permit takes effect, you will be charged two (2) weeks' occupancy fee in advance.
• You will continue to pay all occupancy fees and charges specified in the "Occupancy Permit" clause 3 until an approved new resident starts signing a contract for a term not less than the current agreement term.
• Additional cleaning fees may be charged if the room is not returned in the same condition, causing reasonable wear and tear.
When considering early termination of your occupancy agreement, you are responsible for the following:
• You will be charged a termination fee equivalent to two (2) weeks' rent.
• You will be responsible for paying rent until the earlier of:
-- The termination date of your occupancy agreement; or
-- The date Y Suites signs a bedroom replacement occupancy agreement,
• You will be responsible for paying Y Suites an equivalent value reward as part of the occupancy agreement.
• A departure cleaning fee may be charged if the room is not returned in the same condition, causing reasonable wear and tear.
Note: *Cancellation policy applies only to new students with bookings who have not stayed with us before. Please note that once your contract is in effect, this policy will no longer apply.
